1. Agreement to Terms

Welcome to GoClimbKili. These Terms of Service (“Terms”) govern your use of our website and the booking of Mount Kilimanjaro climbing expeditions and related services (collectively, “Services”). By accessing our website, making a booking, or participating in any of our expeditions, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use our Services or book any expeditions with us.

Company Information:
GoClimbKili is a licensed tour operating company registered and based in Tanzania, specializing exclusively in Mount Kilimanjaro hiking adventures.

2. Eligibility and Age Requirements

2.1 Minimum Age

Climbers must be at least 10 years of age to attempt Mount Kilimanjaro. Climbers between 10-17 years must be accompanied by a parent or legal guardian who accepts full responsibility for the minor.

2.2 Physical and Medical Fitness

Mount Kilimanjaro climbing is a physically demanding activity that involves high-altitude environments. By booking with us, you confirm that:

  • You are in good physical and mental health
  • You have no medical conditions that would make high-altitude climbing dangerous
  • You have disclosed all relevant medical information, including pre-existing conditions, medications, and allergies
  • You have consulted with a qualified medical professional about your fitness for high-altitude trekking
  • You understand the risks associated with altitude sickness and mountain climbing

We reserve the right to request medical certificates or fitness assessments before confirming your booking.

3. Booking and Payment

3.1 Booking Process

To book an expedition, you must:

  • Complete our booking form with accurate information
  • Provide valid passport details
  • Pay the required deposit or full payment as specified
  • Accept these Terms of Service
  • Sign our liability waiver and medical disclosure forms

3.2 Payment Terms

  • Deposit: A non-refundable deposit of [specify amount or percentage] is required to confirm your booking
  • Final Payment: The remaining balance must be paid no later than [specify number] days before your expedition start date
  • Accepted Payment Methods: We accept [credit cards, bank transfers, PayPal, etc.]

3.3 What’s Included in Your Package

Your expedition package includes:

  • Professional mountain guides certified by Kilimanjaro National Park
  • Park entrance fees and camping/hut fees
  • Porters for carrying group equipment
  • Mountain crew (guides, assistant guides, cook, porters)
  • Three meals per day while on the mountain
  • Camping equipment (tents, sleeping mats, dining tent, toilet tent)
  • Safety equipment (oxygen, first aid kit, pulse oximeter)
  • Airport transfers (as specified in your package)
  • Accommodation before and after the climb (as specified in your package)
  • Government taxes

3.4 What’s NOT Included

  • International flights
  • Tanzania visa fees
  • Travel insurance (mandatory – see Section 5)
  • Personal climbing gear (available for rent)
  • Tips for mountain crew (customary and recommended)
  • Personal expenses (laundry, telephone, beverages)
  • Optional activities not specified in your package
  • Medical expenses and evacuation costs

4. Cancellation and Refund Policy

4.1 Cancellations by You

  • More than 60 days before departure: Deposit forfeited; remaining payments refunded
  • 30-60 days before departure: [specify percentage]% of total cost forfeited
  • 15-29 days before departure: [specify percentage]% of total cost forfeited
  • Less than 15 days before departure: 100% of total cost forfeited (no refund)

All cancellations must be submitted in writing via email.

4.2 Cancellations by GoClimbKili

We reserve the right to cancel your expedition due to:

  • Insufficient bookings
  • Force majeure events (natural disasters, political instability, pandemics, etc.)
  • Closure of Kilimanjaro National Park by authorities
  • Safety concerns

If we cancel your expedition, you will receive:

  • Full refund of all payments made, OR
  • Credit toward a future expedition with GoClimbKili

We are not liable for any additional costs you may incur (flights, accommodation, etc.) due to our cancellation.

4.3 No-Show Policy

Failure to arrive for your scheduled expedition without prior cancellation will result in 100% forfeiture of all payments with no refund.

5. Travel Insurance (Mandatory)

5.1 Insurance Requirements

All climbers MUST have comprehensive travel insurance that covers:

  • Medical expenses and emergency treatment
  • Emergency evacuation and repatriation (including helicopter rescue)
  • Trip cancellation and interruption
  • Personal accident coverage
  • Coverage for activities at altitudes up to 6,000 meters (19,685 feet)

5.2 Proof of Insurance

You must provide proof of adequate insurance coverage before your expedition begins. We reserve the right to deny participation to anyone without proper insurance.

5.3 Claims and Liability

GoClimbKili is not responsible for insurance claims. All insurance matters must be handled directly between you and your insurance provider.

6. Health, Safety, and Guide Authority

6.1 Medical Disclosure

You must complete our medical questionnaire honestly and disclose:

  • All pre-existing medical conditions
  • Current medications
  • Allergies and dietary restrictions
  • Previous altitude-related issues
  • Recent surgeries or injuries

Failure to disclose relevant medical information may result in termination of your participation without refund.

6.2 Guide Authority

Our mountain guides have absolute authority regarding:

  • Route decisions and schedule changes
  • Assessment of climber fitness and health
  • Decisions to turn back or evacuate climbers
  • Safety protocols and emergency procedures

By booking with us, you agree to follow all guide instructions without question. Failure to comply may result in termination of your expedition without refund.

6.3 Summit Success

While we maintain excellent summit success rates, reaching the summit is not guaranteed. Factors beyond our control include:

  • Weather conditions
  • Your physical condition and acclimatization
  • Altitude sickness
  • Park authority decisions

No refunds are provided for climbers who do not reach the summit for any reason.

6.4 Evacuation

If our guides determine you must descend for medical or safety reasons:

  • You must comply immediately
  • Evacuation costs are your responsibility (covered by your insurance)
  • No refund will be provided for unused portions of your expedition

7. Assumption of Risk and Liability

7.1 Acknowledgment of Risks

You acknowledge that Mount Kilimanjaro climbing involves inherent risks, including but not limited to:

  • Altitude sickness (AMS, HACE, HAPE)
  • Extreme weather conditions
  • Difficult terrain and risk of falls
  • Wildlife encounters
  • Equipment failure
  • Communication limitations
  • Delays in emergency medical care

7.2 Assumption of Risk

By participating in our expeditions, you voluntarily assume all risks associated with mountain climbing, whether foreseen or unforeseen.

7.3 Limitation of Liability

To the maximum extent permitted by law:

  • GoClimbKili, its owners, employees, guides, and affiliates shall not be liable for any injury, illness, death, or property damage arising from your participation
  • Our liability is limited to the total amount paid for your expedition package
  • We are not liable for acts of third parties, force majeure events, or circumstances beyond our reasonable control

7.4 Indemnification

You agree to indemnify and hold harmless GoClimbKili from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your negligence or misconduct
  • Your failure to disclose medical information
  • Claims by third parties arising from your actions

8. Code of Conduct

8.1 Expected Behavior

All climbers must:

  • Treat guides, porters, and fellow climbers with respect
  • Follow Leave No Trace principles
  • Respect local customs and cultures
  • Comply with Kilimanjaro National Park regulations
  • Refrain from alcohol and recreational drugs during the expedition
  • Maintain reasonable hygiene standards
  • Not engage in any illegal activities

8.2 Termination for Misconduct

We reserve the right to terminate your participation immediately without refund if you:

  • Endanger yourself or others
  • Engage in illegal activities
  • Harass or abuse staff or other climbers
  • Refuse to follow guide instructions
  • Are intoxicated or under the influence of drugs
  • Violate park regulations

9. Intellectual Property and Media

9.1 Our Content

All content on our website, including text, images, logos, and videos, is the property of GoClimbKili and protected by copyright laws. You may not reproduce, distribute, or use our content without written permission.

9.2 Photos and Videos

We may take photographs and videos during your expedition for marketing purposes. By participating, you grant us permission to use your likeness in promotional materials unless you explicitly opt out in writing before your expedition.

9.3 Your Reviews

By submitting reviews, testimonials, or feedback, you grant us a perpetual, royalty-free license to use your content for marketing purposes.

10. Force Majeure

GoClimbKili shall not be liable for failure to perform our obligations due to circumstances beyond our reasonable control, including:

  • Natural disasters (earthquakes, volcanic activity, floods)
  • Extreme weather conditions
  • Government actions or restrictions
  • Pandemics or health emergencies
  • Political instability or civil unrest
  • Strikes or labor disputes
  • Park closures by authorities

In such cases, we will work with you to reschedule your expedition or provide appropriate alternatives.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the United Republic of Tanzania.

11.2 Arbitration

Any disputes arising from these Terms or your expedition shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Tanzania under the Tanzanian Arbitration Act.

11.3 Complaints Procedure

If you have a complaint:

  1. Raise it immediately with your guide during the expedition
  2. If unresolved, submit a written complaint within 14 days of expedition completion
  3. We will respond within 30 days with our resolution

12. Changes to Itinerary

We reserve the right to modify expedition itineraries due to:

  • Weather conditions
  • Park authority requirements
  • Safety considerations
  • Force majeure events

We will make reasonable efforts to provide comparable alternatives. No compensation or refund will be provided for itinerary changes made for safety or circumstances beyond our control.

13. Environmental and Ethical Commitment

13.1 Porter Welfare

GoClimbKili is committed to ethical treatment of our mountain crew. We:

  • Pay fair wages exceeding industry standards
  • Provide proper equipment and safety gear
  • Limit porter loads according to regulations
  • Provide adequate food and shelter
  • Maintain insurance for all crew members

13.2 Environmental Responsibility

We practice responsible tourism by:

  • Following Leave No Trace principles
  • Properly disposing of all waste
  • Minimizing environmental impact
  • Supporting local conservation efforts

We expect all climbers to share these commitments.

14. Personal Belongings

14.1 Your Responsibility

You are solely responsible for your personal belongings. GoClimbKili is not liable for:

  • Lost, stolen, or damaged personal items
  • Luggage delays or loss by airlines
  • Theft from accommodations or during transport

14.2 Insurance Coverage

Ensure your travel insurance covers personal belongings and valuables.

15. Communication and Language

Expedition briefings and communications are conducted primarily in English. If you require services in another language, please request this at booking (additional fees may apply).

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

For bookings made before Terms modifications, the Terms in effect at the time of booking will apply.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and GoClimbKili.
